Terms of Service
These terms govern your use of Botsona, the AI usability testing service at botsona.io and app.botsona.io. You accept them when you create an account and confirm that you agree. If you do not agree, do not create an account or use Botsona.
Who you are agreeing with
These terms are an agreement between you and Deep Variance Inc., a Delaware corporation ("Deep Variance", "we", "us"). If you use Botsona for an organisation, you confirm you may accept these terms for it, and "you" includes that organisation. Contact: founders@deepvariance.com.
What Botsona does
Botsona sends AI testers to a website you choose. Each tester acts like a specific kind of person and tries a task or looks round the site in a browser in our cloud. Botsona records what they do: steps, screenshots, screen recordings, page problems and an accessibility check. It then writes a report of where they got stuck and what to fix.
The testers, their behaviour and the reports are produced by AI. They can be wrong, miss problems, or describe problems that real people would not have. Botsona does not replace testing with real people, and its accessibility check is not a full accessibility audit or proof of legal compliance.
Accounts
You must be at least 18, or the age of majority where you live, and give an accurate email address. Keep your password secure; you are responsible for activity under your account. Tell us promptly if you believe it has been compromised.
Botsona is invite-only and free during this period. We set limits on how many tests you can run and how much they may cost, shown in the app, and we may change them. If we introduce paid plans, we will ask you to agree to their terms before charging you anything.
Only test sites you may test
You may only point Botsona at websites that you own or operate, or that you are authorised to test by the people who do. Testers behave like visitors: they click, scroll, fill in forms with made-up details and may submit them, and a site scan crawls up to 500 pages and checks up to 1,500 links (it obeys robots.txt). This can create accounts, send messages from the site's forms or add load to it. You are responsible for choosing what to test and for any effect on the site.
Testers refuse to press buttons that would pay, delete or send something for real, and they ignore instructions written on the pages they visit. These safeguards reduce risk but cannot guarantee that a test has no effect on the site.
Acceptable use
You agree not to:
- test a website without the authorisation described above, or use Botsona to attack, overload, scrape or probe a site for weaknesses;
- use Botsona to break the law or infringe anyone's rights;
- give Botsona real personal data, passwords or payment details that are not yours to share, for example in a task description;
- attempt to access another person's account or data, or bypass our limits, billing or security controls;
- resell or provide Botsona to third parties as a service without our written permission;
- reverse engineer Botsona except to the extent the law allows despite this restriction;
- use Botsona in breach of US export control or sanctions laws. You confirm that you are not located in, or acting for anyone in, a country or region subject to comprehensive US sanctions, and that you are not on a US government restricted party list.
Your data and your content
You keep all rights in your websites, the tasks you write, and the reports and recordings made for you. You give us only the limited permission needed to process them to provide Botsona to you, including sending page content and screenshots to our AI provider, as described in the Privacy Policy. We will keep your content confidential, use it only to provide Botsona to you, protect it with reasonable security measures, and not use it to train AI models.
You can delete any test at any time, which deletes its steps, screenshots, recordings and report. To delete your account, email us from its address.
We collect product usage data with personal details masked, to understand and improve Botsona. You can turn it off in Settings at any time. The Privacy Policy describes exactly what it contains.
Feedback is optional. If you send it, we may use it without obligation to you.
Our rights
Subject to these terms, we give you a limited, non-exclusive, non-transferable, non-sublicensable licence to use Botsona for your own internal purposes while your account is active. Botsona, its websites, software and content otherwise belong to Deep Variance or its licensors. Open-source components are licensed under their own licences, and nothing here limits your rights under them.
Suspension and termination
You can stop using Botsona at any time. We may suspend or close an account that breaks these terms or puts Botsona, the sites it tests or other users at risk. Where reasonable, we will tell you first and give you a chance to fix the problem. We may end the invite-only period or discontinue Botsona with reasonable notice. Sections that by their nature should survive (your content, feedback, our rights, disclaimers, limitation of liability, indemnity, governing law and General) survive.
Disclaimers
Except as expressly stated in these terms, Botsona is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that Botsona will be uninterrupted or error-free, or that its reports will be complete or accurate. Some jurisdictions do not allow these exclusions, so some of them may not apply to you.
Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if advised of the possibility. Each party's total liability arising out of these terms is limited to the greater of the fees you paid us in the 12 months before the claim arose and one hundred US dollars.
These limits do not apply to your indemnity obligations, your breach of the Acceptable use or "Only test sites you may test" sections, or liability that cannot be limited by law, such as liability for fraud.
Indemnity
You will defend and indemnify Deep Variance against third-party claims arising from a website you had Botsona test, your content, or your breach of these terms. The party seeking indemnity must give prompt notice and reasonable cooperation.
Changes to Botsona and these terms
We improve Botsona and may change or discontinue features. We may update these terms. For a material change, we will give at least 30 days notice on botsona.io and by email to account holders, and ask you to accept the new version in the app. Continuing to use Botsona after it takes effect means you accept the updated terms.
Governing law and disputes
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising from these terms or Botsona, and both parties consent to that jurisdiction. Nothing here removes rights you have under the mandatory consumer protection laws of the country you live in.
General
These terms are the whole agreement between you and us about Botsona. Our Privacy Policy explains how we handle personal data and is not part of this agreement. If you have a separate signed agreement with us covering Botsona, that agreement controls where it conflicts with these terms. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. Neither party may assign these terms without the other's consent, except to a successor in a merger, acquisition or sale of all or most of the relevant business, with notice to the other party. Neither party is liable for delays caused by events beyond its reasonable control.
You agree that we may give you notices about your account and these terms electronically, by email to your account email or in the app, and that these satisfy any legal requirement that they be in writing.
